1. Purpose and scope

These Terms & Conditions (the “Terms”) govern access to and use of funstorming.com (the “Website”) and the purchase and provision of Funstorming’s products and services (the “Services”). They combine the terms of use of the Website and the terms of sale of the Services, and apply between Funstorming (the “Provider”, “we”) and any user or customer (the “Client”, “you”).

3. Acceptance

By accessing the Website, creating an account, joining the community, registering for an event, or placing an order, you accept these Terms without reservation. The version applicable to an order is the one in force when the order is placed. We may update the Terms; changes do not affect orders already placed.

4. The Services and how they are sold

Funstorming currently offers the following distinct offerings. The exact content, scope, format, schedule and price of each are described on the relevant order or event page.

4.1 100-Quest Playbook — one-time payment

The 100-Quest Playbook is a downloadable digital product. A single, one-time payment grants the Client access to the full Playbook for personal use only; commercial use is prohibited. Access lasts for as long as the product and platform remain reasonably available. The Playbook is updated approximately every two years, when a new edition of the World Economic Forum’s Future of Jobs report is published. “Lifetime”, where used, refers to the commercial lifetime of the product and does not create a perpetual obligation if the Service is permanently discontinued.

4.2 100-Quest LMS (“Player”) — subscription (recurring)

The 100-Quest LMS is an online course hosted on the Forento learning platform. It is sold as a recurring annual subscription (the “Player” plan), granting personal access to the 100-Quest content and to the FunBot AI, which helps determine which quests to follow based on the use case described by the user.

4.3 What The Fun!? — weekly events (paid attendance or included in a subscription)

“What The Fun!?” are recurring (weekly) events open to everyone, whether or not the person has purchased the Playbook, holds a subscription, or has made no purchase. They are included in the 100-Quest LMS subscription. A first attendance is free; subsequent attendance by non-subscribers is a paid event. Participation remains subject to these Terms, the Content Policy and the Code of Ethics.

4.4 FunCamps Laser Coaching & 1:1 coaching — subscription (recurring)

Access to the EPIC or LEGEND tier of the Discord community (“FunCamps Laser Coaching”), including 1:1 coaching, is sold as a recurring subscription — monthly or annual — processed through Whop (whop.com). The subscription gives access for its term and renews automatically until cancelled by the Client.

4.5 Tips and other payments

Funstorming may accept voluntary tips and other payments, in fiat currency or cryptocurrency, in connection with evolving services and one-off activities. Such tips and payments are voluntary and, once made, are non-refundable.

Funstorming accepts payment in the following cryptocurrencies: MANA, ETH and POL, on the Ethereum and Polygon blockchains. Prices are set in euros (EUR); the crypto amount due is calculated at the applicable exchange rate at the time of payment. The Client bears all exchange-rate fluctuations and network ("gas") fees. Blockchain transactions are final and irreversible: payments sent to the wrong address or on an unsupported network cannot be recovered, and Funstorming is not responsible for such losses. Tips and crypto payments, once confirmed on-chain, are non-refundable.

4.6 Consultant services (FunLab / FunJob)

This offering is reserved for corporate initiatives and private collective-intelligence events that involve organisational, consultant-type work. Pricing is on request and provided by quotation (devis). Engagements are delivered either in project mode (“FunLab”) or as event planning (“FunJob”), as specified in the applicable quotation or agreement, which prevails over these Terms for that engagement in case of conflict.

5. Accounts and third-party platforms

Some Services require an account with us and/or with third-party platforms (Forento for the LMS, Whop for subscriptions, Discord for the community, and Decentraland for the gamified environment). You agree to provide accurate information, keep your credentials confidential, and comply with each platform’s own terms. You are responsible for any third-party account they require (including any wallet for Decentraland). We are not responsible for those platforms’ availability or practices.

6. Prices and taxes

Prices are those displayed at the time of the order, in euros.

Prices are stated exclusive of VAT. VAT not applicable, Article 293 B CGI' if under the exemption scheme, otherwise the applicable rate.

We may change prices at any time; the price applicable to an order is the one displayed when the order is placed. For subscriptions, price changes apply from the next renewal after reasonable notice.

7. Payment

The 100-Quest Playbook is paid in a single payment at the time of order through the Forento platform and its payment processors. The 100-Quest LMS subscription is billed by Forento and FunCamps subscriptions are billed by Whop on a recurring basis according to the plan chosen. We do not store full payment-card details. Access to a paid Service may be suspended in case of non-payment. For B2B transactions, statutory late-payment interest and the fixed €40 recovery indemnity apply (Articles L.441-10 and D.441-5 of the French Commercial Code).

8. Right of withdrawal (consumers)

If you are a consumer purchasing at distance, you generally have a 14-day right of withdrawal from the conclusion of the contract (Article L.221-18 of the French Consumer Code).

Exception for digital content and immediate access: where you are given immediate access to the 100-Quest (digital content supplied without a tangible medium) or to a subscription that starts immediately, you will be asked to give your express prior consent to immediate performance and to acknowledge that you thereby waive your right of withdrawal once access has been provided. After access is granted, the withdrawal right no longer applies.

Free events involve no payment and therefore no withdrawal right. Business clients (B2B) do not benefit from the consumer withdrawal right unless otherwise agreed.

9. Provision of the Services

We provide the Services with due care and skill (obligation de moyens). Availability of the 100-Quest depends on the Forento platform; availability of the VIP community depends on Discord and Whop; events depend on the relevant platform. We may adjust, update or discontinue content or events, giving reasonable notice where this materially affects a paid Service.

10. Client obligations and acceptable use

You agree to use the Website, Services, community and events lawfully and in line with our Content Policy and Code of Ethics, and not to: infringe our or third parties’ rights; share, resell or redistribute access or content without authorisation; disrupt the Services; or upload unlawful, harmful or infringing content. We may suspend or terminate access in case of breach.

11. Intellectual property

All materials provided as part of the Services — courses, frameworks, games, serious games, frame games, templates, digital assets and the Funstorming brand — remain the exclusive property of Funstorming or its licensors. Subject to full payment, you receive a personal, non-exclusive, non-transferable licence to use the materials for your own purposes for the duration of the relevant Service. Reproduction, distribution or resale is prohibited without our prior written consent.

12. Liability

To the maximum extent permitted by law, Funstorming is not liable for indirect or consequential damages (including loss of profit, data or opportunity). Where our liability is engaged, it is limited to the amounts paid by the Client for the Service concerned over the 12 months preceding the event. Nothing excludes liability that cannot be excluded under French law, including consumers’ statutory rights and the legal guarantee of conformity.

14. Term, suspension and termination

These Terms apply for as long as you use the Website or Services. Subscriptions end at the end of their term or upon cancellation. Lifetime access ends only if the product is permanently discontinued. We may suspend or terminate access in case of breach, non-payment, or as required by law, without prejudice to amounts due.

15. Force majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control within the meaning of Article 1218 of the French Civil Code.

16. Complaints and consumer mediation

For any complaint, contact us first at info@funstorming.com. In accordance with Articles L.612-1 et seq. of the Consumer Code, a consumer may use a consumer mediator free of charge.

17. Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable solution, the competent French courts have jurisdiction; for disputes with business clients (professionnels), exclusive jurisdiction is given to the courts of Nouméa (New Caledonia). Consumers may rely on the protective rules of jurisdiction, including the court of their place of residence.

18. Miscellaneous

If any provision is invalid, the others remain in force. Our failure to enforce a right is not a waiver. These Terms (with any quotation or specific agreement) form the entire agreement for the relevant Service.
